These terms and conditions have been written in plain English
to make sure they can be understood without the need for expensive
legal assistance, please treat them as such.
General Hosting Conditions of Use
ECSWeb provide use of server space for email accounts and for
hosting of web sites.
We reserve the right to suspend, restrict or terminate any customers
account where the customer is in breach of this agreement.
Reselling of Our Services
Reselling our services is prohibited.
Each account may host only one website.
The account holder must at all times retain control over the
services we provide to him/her.
Prohibited Use
No hosting account may be used to hold or transmit illegal or
imoral content including but not restricted to:
- "Adult" material
- pornography
- lewd or otherwise obscene content.
- Racist, defamatory or hate inducing content.
- Copyrighted material (except where the copyright holders permission
has been obtained).
ECSWeb reserves the right to suspend accounts or terminate accounts
or remove any material deemed to be harmful to their image without
refund or notice.
SPAM otherwise known as Bulk Unsolicited
Commercial Email
ECSWeb prohibits the sending of Spam via their services and no
account may be used to collect responses from, or be used as as
a target of any Spam.
Charges may be levied against the account holder for any "cleaning
up" following spam activity by or on behalf of the account
holder and the account may be closed without refund.
Payment of Accounts
All accounts are sold on a twelve month basis and renewals occur
on the anniversary of the date hosting commenced.
The account holder must give 28 days notice before renewal date
if they wish to cancel an account.
Failure to settle an account by the renewal date could result
in suspension of services and in some cases there may be an administration
charge for reinstatement. If there is some reason for the payment
to be held up, please make contact with us.
All accounts must be settled in UK Sterling.
System Resources
As the server which your site is hosted on will be used by other
accounts, we must ensure a satisfactory level of performance for
all accounts. Any account found to hog resources will result in
the account holder being contacted to explore ways to resolve
the issue.
Excessive bandwidth might incur additional charges which will
be agreed by both parties.
Cancellation
Cancellation of a hosting account must be made at least 28 days
before renewal and we reserve the right to confirm that the person
cancelling the account is entitled to do so.
Backup of Data
Unless otherwise agreed, account holders are responsible for
their own data backup.
Distance Selling Regulations (applicable
to UK customers only)
Under the terms of The Consumer Protection (Distance Selling)
Regulations 2000, consumers have a `cooling off` period of 7 working
days from the date that the order is placed in which they may
cancel orders placed by distance contract.
The Consumer Protection (Distance Selling) Regulations 2000 do
not apply to business-to-business transactions, or to transactions
to those outside the UK.
Liabilities
ECSWeb will not be responsible for any loss or damage your business
may suffer. All services are offered on a best endeavour basis
only because there are so many circumstances and the actions/failings
of other individuals or companies are beyond our control.
Customers are wholly responsible for ensuring that their use
of our services complies with all applicable laws and regulations
and they shall indemnify and hold harmless ECSWeb from any and
all demands, liabilities, losses, costs, and claims, including
all legal fees, asserted against ECSWEb and it`s agents, customers,
officers and employees, that may arise from any service provided
or performed or agreed to be performed, or for any product sold
by ECSWeb, it`s agents, customers, officers or employees.
